Hiring in South Korea: Complete Guide 2027
Everything you need to know about hiring and managing employees in South Korea

Overview
South Korea is Asia's fourth-largest economy, home to Samsung, SK hynix, LG and Hyundai, so most EOR hires here are engineers. Employer on-costs are low: the four social insurances add about 10 to 11% to gross pay in 2026, with the National Pension at 4.75% on the employer side after the January 2026 rise. The expensive item sits elsewhere. The Employee Retirement Benefit Security Act gives every employee with a year of service 30 days' wage per year worked, funded through a DB or DC plan at 8.33% of pay. Add an EOR fee of USD 500 to 900 a month and a Korean hire costs 30 to 40% above gross.

PAYROLL & SETUP
Setting Up Payroll in South Korea
Payroll runs monthly in KRW. The employer registers with the National Tax Service (Hometax) and enrols staff in the four social insurances through the Social Insurance Information Service within 14 days. Employer rates for 2026: National Pension 4.75% (9.5% in total since 1 January 2026, rising 0.5 point a year to 13% in 2033) on income capped at about KRW 6.37 million a month; National Health Insurance 3.595% plus long-term care at 13.14% of the health premium; employment insurance 0.9% plus a 0.25 to 0.85% levy by company size; accident insurance from about 0.7% for offices. Minimum wage: KRW 10,320 an hour from 1 January 2026, KRW 2,156,880 a month on 209 hours. Withholding follows the Income Tax Act schedule, 6 to 45% plus a 10% local surtax, or a flat 19% for foreign employees who elect it. The EOR files the withholding return by the 10th of the next month, the year-end settlement in February and the retirement plan.

COMPLIANCE
Dispatch Act, Working Hours and Severance Compliance in South Korea
The Act on the Protection of Dispatched Workers decides how an EOR may employ for you. Worker dispatch needs a Ministry of Employment and Labor licence, is restricted to 32 job categories and ends at two years. Most providers therefore employ staff through their own Korean entity on a service contract, so the first thing to ask is which model applies and which entity signs. The Labor Standards Act then sets a 40-hour week with a 52-hour ceiling including overtime at 150%, 15 days' leave after one year, and dismissal only for just cause with 30 days' notice or pay and written grounds; the Labor Relations Commission hears unfair dismissal claims within three months. Severance of 30 days' wage per year is due within 14 days of leaving.
Key Challenges
- Dispatch Act limits leased staff to 32 job categories and two years
- Statutory severance of 30 days' wage per year of service, funded through a DB or DC plan
- 52-hour weekly ceiling, overtime at 150%
- Dismissal only for just cause, challengeable at the Labor Relations Commission
- Korean-language contracts and Rules of Employment from 10 staff
