Overview

Indonesia is Southeast Asia's largest economy and a market of 280 million people, with Jakarta as the hub for tech, fintech and consumer businesses. Employer on-costs are moderate at 10–12% of gross for BPJS social security and health, but the mandatory THR religious holiday allowance adds a thirteenth month and severance for long-tenured staff can reach 15–20 months. A foreign-owned PT PMA needs IDR 10 billion in paid-up capital, which is why most companies hire their first Indonesian employees through an EOR.

PAYROLL & SETUP

Setting Up Payroll in Indonesia

Indonesian payroll runs monthly in IDR. The employer registers for an NPWP, with both BPJS funds and with the Ministry of Manpower (WLKP). Employer contributions total 10.24–11.74% of gross: JKK work accident 0.24–1.74% by risk class, JKM death 0.30%, JHT old age 3.70%, JP pension 2% up to IDR 10,547,400 per month (2025 cap, adjusted yearly) and 4% of the 5% BPJS Kesehatan health premium, capped at IDR 12,000,000. JKP unemployment cover comes from a 0.36% recomposition of JKK plus a government share, nothing extra. Employees pay JHT 2%, JP 1% and health 1%; the employer's 4% health share is taxable income for PPh 21, withheld monthly at 5–35% with the TER tables. Jakarta's 2026 UMP is IDR 5,729,876 per month, up 6.17% from IDR 5,396,761 (GR 49/2025). THR, one month's salary, is due seven days before Eid, pro-rated under twelve months. The EOR files the monthly PPh 21 and BPJS returns and the annual 1721-A1 slips.

Termination Rules

  • Severance + long-service pay, 0.5× to 1.75× by ground

COMPLIANCE

PKWT Contracts and Termination Compliance in Indonesia

Indonesia has two contract types. Fixed-term PKWT contracts are capped at five years in total under the Job Creation Law (Law 6/2023 and GR 35/2021) and owe compensation pay at the end of every term; permanent PKWTT contracts follow a probation of at most three months. Ending a PKWTT is the costly part: termination goes through bipartite negotiation and, failing agreement, mediation and the industrial relations court. The package combines severance pay (up to 9 months), long-service pay (up to 10 months) and compensation of rights, multiplied by 0.5 to 1.75 depending on the ground, so a long-tenured exit can cost 15–20 months. Notice is 14 working days. An EOR drafts the bilingual contract, tracks PKWT terms and runs the exit calculation.

Key Challenges

  • THR: a thirteenth month paid before Eid, pro-rated under 12 months of service
  • Severance packages of 15–20 months for long-tenured exits
  • Fixed-term PKWT contracts capped at 5 years in total, with end-of-term compensation
  • Indonesian-language contract version required for every local hire
  • RPTKA approval and KITAS permit for every foreign hire
