Overview

The Netherlands is the most English-fluent labour market in continental Europe and a dense hub for logistics, fintech, semiconductors and SaaS. Employment law is protective: dismissal needs permission from the UWV or a court ruling, sick pay runs for up to 104 weeks, and a third fixed-term contract turns permanent after three years. For a foreign company, an EOR avoids a Dutch B.V., a KVK registration and a wage tax number. Employer premiums come to 16–18% of gross up to the premium ceiling, about 18–22% all-in once the sector pension most CAOs impose is added, before the 8% holiday allowance.

PAYROLL & SETUP

Setting Up Payroll in the Netherlands

Dutch payroll runs monthly. An employer registers with the Belastingdienst for a wage tax number and files a monthly return (loonaangifte) for wage tax and premiums. Employer premiums in 2026 come to about 16–18% of gross up to the €79,409 maximum premium wage: Awf unemployment 2.74% on permanent contracts, 7.74% on flexible ones, disability Aof 6.27% for small employers (7.63% large), the Whk return-to-work premium around 1.2%, and the Zvw employer levy of 6.10%. A pension where a CAO or sector fund requires one, often 15–25% of pensionable salary, typically split, takes the all-in on-cost to the 18–22% shown above. The 8% holiday allowance (vakantiegeld), paid in May, comes on top. The statutory minimum wage is €14.71 an hour from January 2026 and €14.99 from 1 July 2026. An EOR carries the wage tax number, files the loonaangifte, pays holiday allowance and pension premiums, and files the 30% ruling for incoming specialists.

COMPLIANCE

Dismissal Permission and Waadi Rules in the Netherlands

A Dutch employer cannot dismiss unilaterally. Economic and long-term illness dismissals need prior UWV permission; personal grounds go to the sub-district court. The statutory transition payment is one third of a month's salary per year of service from day one, and notice runs from one month under five years of service to four months over fifteen. Most exits end in a termination agreement with a 14-day reflection period. The second rule concerns the EOR itself: a company that leases staff must show a Waadi registration in its KVK extract, and the hirer is jointly liable for its unpaid wage tax and premiums. SNA certification (NEN 4400-1) and a G-account deposit cap that liability. Without both, the risk stays with you.

Key Challenges

  • Dismissal needs UWV permission or a court ruling
  • Sick pay of at least 70% for up to 104 weeks
  • Chain rule: 3 fixed-term contracts in 3 years, then permanent
  • Sector pension funds and CAOs bind most employers
  • Waadi registration and SNA status decide who may lease staff

Country Highlights
