Overview

Morocco is the nearshore market for French-speaking companies: Casablanca and Rabat run the offshoring parks, Tangier and Kenitra the automotive plants. Employer CNSS is 21.09% at the minimum wage, but two of its five lines stop at MAD 6,000 a month, so the rate falls to about 15% on a MAD 20,000 salary. The Code du travail (loi 65-99) makes the CDI the default and limits CDD use. A dismissal needs a serious reason and a hearing. An EOR here must hold the staff-leasing authorisation of the Ministère de l'Emploi, and that is the first thing to ask for.

PAYROLL & SETUP

Setting Up Payroll in Morocco

Moroccan payroll runs monthly in dirhams. The employer needs a CNSS affiliation, a tax identifier (IF) with the DGI and an ICE before the first declaration. Employer contributions in 2026: family allowances 6.40%, AMO health insurance 4.11% and the vocational training tax 1.6% on the full salary; short-term benefits 1.05% and long-term benefits (pension) 7.93% on pay capped at MAD 6,000 a month. That is 21.09% at the minimum wage and about 15% on MAD 20,000. The employee pays 4.48% on the capped base and 2.26% AMO on everything. The SMIG is MAD 17.92 an hour from 1 January 2026, about MAD 3,422 for the legal 191 hours (MAD 17.10 in 2025). Income tax (IR) is withheld monthly on annual brackets: 0% to MAD 40,000, then 10%, 20%, 30%, 34% and 37% above MAD 180,000. The EOR files the monthly CNSS declaration on Damancom, pays the IR to the DGI and issues the payslip.

COMPLIANCE

Dismissal Procedure and Staff-Leasing Authorisation in Morocco

The Code du travail (loi 65-99) sets a 44-hour week, a probation of 3 months for cadres, 1.5 months for employés and 15 days for workers, renewable once, and 1.5 working days of leave a month. A dismissal needs a serious reason, a hearing within eight days under article 62 and a written record; without them the dismissal is abusive and article 41 damages run 1.5 months per year of service, up to 36 months. Notice follows décret 2.04.469: one to three months for cadres by seniority. Severance under article 53 starts after six months, at 96 hours of pay per year for the first five years. A firm placing staff with clients is a temporary-work agency under article 495 and needs the Ministère de l'Emploi authorisation; your EOR should show it.

Key Challenges

  • CDD contracts only in the cases the Code du travail lists, one year renewable once
  • Dismissal needs a serious reason, the article 62 hearing and a written record
  • Damages for abusive dismissal: 1.5 months per year of service, up to 36 months
  • A foreign hire waits for the ANAPEC attestation and a contract stamped by the Ministry
  • Staff leasing needs a Ministère de l'Emploi authorisation (articles 495 and following)
